Scottish Pubs Code now in full effect – including right to request a rent review

The Scottish pubs sector passed a major milestone yesterday (30th June) when the second section of the Scottish Pubs Code legislation came into effect. 

The long-gestating legislation – which governs the relationships between pub companies and their tenants – went live in two tranches, with the first part coming into force in April. 

The second tranche, which is now live, gives pub company lessees the right to request a review of their rent  and to request a market-rent-only lease, allowing them to source beer and other products from other suppliers.

The code is overseen by adjudicator Sarah Havlin, who said: “This is a significant step forward for pubs across Scotland. The new framework ensures a level playing field and delivers real benefit across the sector.

“I will maintain active engagement across the sector to ensure the Code continues to serve both tenants and landlords effectively.”
